Terms of Service

Acceptance of Terms

By downloading, installing, or using Aviate ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App. By using the App, you represent and warrant that you meet these requirements.

Description of Service

Aviate is a flight tracking and management application that allows users to:

  • Scan and store boarding passes
  • Manually track flights
  • View real-time flight status and location
  • Share flight information with others (public link sharing requires a paid subscription)
  • Access airport maps and layover information (requires a paid subscription)
  • Create and join flight groups with end-to-end encrypted flight sharing (requires a paid subscription)
  • Upload and manage trip documents
  • Import flight data from third-party apps (such as Flighty or byAir)
  • Create custom trips by grouping flights together
  • Save parking information for your trips
  • Create and manage travel checklists
  • View airport operational status, delays, and NOTAMs
  • View delay predictions based on historical and weather data (requires a paid subscription)
  • Search and browse your flight history
  • Sync flight data to a WearOS companion app on a paired smartwatch
  • Receive live flight notifications and parking reminders (available with a paid subscription)

Account Registration

To use the App, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

Subscriptions and Payments

Aviate offers free and paid subscription tiers. The free tier includes core features such as boarding pass scanning, manual flight tracking, flight status, trip documents, checklists, parking information, and flight data import. The paid Pro subscription unlocks additional features including live flight notifications, flight groups, public flight link sharing, delay predictions, airport maps, aircraft tracking, passport badges, and customizable app icons. Aviate reserves the right to change which features are included in each tier at any time. For paid subscriptions:

  • All purchases are processed exclusively through Google Play Billing
  • Subscription prices are displayed in the App before purchase
  • Recurring subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • You can manage or cancel your subscription through the Google Play Store at any time
  • All purchases are final and non-refundable, except where required by applicable consumer protection law or Google Play's refund policies
  • All refund requests must be submitted through Google Play. Aviate does not process refunds directly
  • The "Lifetime" purchase option grants access to Pro features for the lifetime of the product (i.e., for as long as Aviate continues to operate), not for the lifetime of the purchaser. If Aviate is permanently discontinued, no refund of the lifetime purchase will be issued

User Content

You retain ownership of any data you provide to the App, including boarding passes, flight information, and form responses. By using the App, you grant us a limited license to store, process, and display this data solely for the purpose of providing the service to you.

Groups

Aviate allows you to create or join flight groups. When using groups:

  • You may create up to 5 groups
  • Your username is visible to other members of groups you join
  • Flight data shared within groups is end-to-end encrypted and can only be viewed by group members
  • You are responsible for the content you share within groups
  • You may leave a group or remove your shared flight data at any time

Trip Documents

You may add documents to your trips within the App. By adding documents, you acknowledge that:

  • Documents are stored locally on your device and are not uploaded to our servers
  • Documents are automatically removed after the associated trip has ended
  • You are solely responsible for the content of documents you add

Flight Data Import

You may import flight data from third-party apps (such as Flighty or byAir) by selecting a CSV export file. By importing data, you acknowledge that:

  • You are responsible for ensuring you have the right to export and import the data
  • Imported flight details are sent to our servers and treated the same as manually added flights
  • Aviate is not affiliated with any third-party flight tracking apps and does not guarantee compatibility with their export formats
  • The original CSV file is not uploaded or stored by Aviate

Parking Information

You may save parking information for your trips, including location details, GPS coordinates, photos, cost, and booking references. By using this feature, you acknowledge that:

  • All parking data is stored locally on your device and is not uploaded to our servers
  • GPS coordinates and photos are captured and stored on-device only
  • You are solely responsible for the accuracy of saved parking information
  • The "Navigate to Car" feature opens your device's default maps app with your saved coordinates; Aviate is not responsible for navigation accuracy

Checklists

You may create travel checklists and packing lists within the App. By using this feature, you acknowledge that:

  • All checklist data is stored locally on your device and is not uploaded to our servers
  • You are solely responsible for the content of your checklists

Shared Flights

When you share a flight, you acknowledge that:

  • Your email address will be visible to recipients
  • Anyone with a shared flight link can view the flight details and real-time position data
  • You are responsible for who you share flight links with
  • You can revoke access to shared flights at any time

Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App's systems or other users' accounts
  • Interfere with or disrupt the App's functionality or servers
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to scan or store boarding passes that do not belong to you without the passenger's consent
  • Use automated systems or bots to access the App
  • Attempt to circumvent app integrity checks or use modified or unauthorized versions of the App

Indemnification

You agree to indemnify, defend, and hold harmless Aviate and its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, your violation of any third party's rights, or your unauthorized scanning or sharing of boarding passes or flight information.

Intellectual Property

The App, including its design, code, features, and branding, is the property of Aviate and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

Flight Data Accuracy

Flight information displayed in the App (including status, times, gates, locations, delay predictions, and airport operational status) is sourced from third-party providers and may not always be accurate or up to date. Aviate does not guarantee the accuracy of flight data, delay predictions, or airport status information and should not be relied upon as the sole source of flight information. Always verify critical flight details with your airline.

Limitation of Liability

To the maximum extent permitted by applicable law, Aviate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, missed flights, or travel disruptions arising from your use of the App. The App is provided "as is" and "as available" without warranties of any kind, either express or implied. In no event shall Aviate's total aggregate liability exceed the amounts you have paid to Aviate in the twelve (12) months preceding the claim.

Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in behavior that is harmful to other users or the service, including but not limited to repeated violations, fraudulent activity, or actions that compromise the security or integrity of the service. If Aviate terminates your account for cause, no refund of prepaid fees will be issued. You may delete your account at any time by contacting us. Upon deletion, your data will be removed in accordance with our Privacy Policy.

Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms within the App. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Nothing in these Terms affects your statutory rights as a consumer.

Dispute Resolution and Arbitration

For users in the United States:Any dispute arising from or relating to these Terms or the App shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. You and Aviate each waive the right to a jury trial and the right to participate in class actions, class arbitrations, or representative proceedings. You may bring claims only on your own behalf. This arbitration agreement shall survive termination of these Terms. Either party may bring claims in small claims court if eligible.

For users outside the United States: Any dispute arising from or relating to these Terms or the App shall be resolved through good-faith negotiation first, and if unresolved, through the competent courts of your place of residence in accordance with applicable local consumer protection laws.

Force Majeure

Aviate shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to third-party service or API disruptions, internet or infrastructure outages, natural disasters, pandemics, or government actions.

Electronic Communications

By creating an account, you consent to receive electronic communications from Aviate, including service-related emails, push notifications, and in-app messages. You may opt out of non-essential communications at any time through the App's settings or by contacting us.

Assignment

Aviate may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets. You may not assign or transfer any rights or obligations under these Terms without Aviate's prior written consent.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aviate regarding your use of the App and supersede any prior agreements or understandings, whether written or oral.
